Expounding the legal implications of CCTV in South Africa

As the use of CCTV in South Africa grows, companies are faced with difficult choices in terms of what they can and cannot legally do with their cameras and the footage they take. When is your footage admissible in court, when will it be deemed illegal?

There are regulations offering clear guidelines to the use of CCTV in other countries making it easier to set up and maintain a legally admissible surveillance system. Unfortunately, there are no similar guidelines in South Africa. To avoid a hit and miss scenario when having to submit surveillance material in legal cases, Hi-Tech Security Solutions in association with Dr Craig Donald, will host iLegal 2008 on 20 October in Johannesburg.

iLegal is an independent conference highlighting the critical legal issues facing people and companies responsible for designing, operating and using CCTV systems and dealing with video evidence in the South African environment.

The iLegal agenda covers the following critical aspects of CCTV usage in South Africa:

International legislation affecting CCTV: What international legislation is emerging, what is it typically aimed at and what are the international trends in the UK, Australia and other major countries?

How does SA law impact on your conduct of CCTV: What is the legal framework that impacts on CCTV, including legislative, common law, case law, human rights and privacy issues. What are the implications of these and are there new legislation requirements that users should be aware of?

How does SA law affect the design of your system and getting the perfect evidence: Legal issues that influence system design and implementation and the lessons learned from the past.

Operating in the South African CCTV environment: Learn from an end-user what legal issues have been encountered and how they were resolved while operating CCTV across a number of sites and dealing with crimes ranging from common theft to armed robbery.

Building legal and privacy protection into CCTV practice: Why is there even a need for protection and what governs conduct of CCTV? Hear about approaches to ensure compliance and CCTV policies and procedures that should be in place to protect the organisation and the rights of those around it.

From incident to successful evidence presentation: Best practice advice on evidence handling procedures with the correct steps to follow after an incident. How should it be retrieved and who should handle the evidence?

Following the presentations, a panel discussion will be held to address topical questions of concern to delegates.
